Need to know

I have 2 shippers in my warehouse [North Jersey] that will have to go to auction. We have sent the certified letters but I can't get a straight answer on the next step. Even the Board of Consumer Affairs gave me a vague reply. I have done this before and we had to have a public auction that was advertised in 2 newspapers. But this was yaers ago and I don't have it commited to memory. Anyone know the fine details or maybe could shoot me a link for something we could download? The red tape so far has gotten pretty thick and we have gotten nowhere quick. Thanks in advance to anyone who might chime in.

I auction stuff off all the time, I'm the Simon Legree of delinquent storage customers....but I'm in Georgia....this stuff is covered state by state, each may be different, so I recommend you get with a local lawyer to get advice. I give plenty of advice, but a lot of it is wrong, so get you some good advice from a lawyer, and then you'll have it on file for future use.

We could hire a lawyer, but we were trying not to incur any additional expences. I can't believe that the Board of Consumer Affairs and the NJMWA couldn't give me a straight answer.

well then call around to other NJ movers, surely some of them have done this. Maybe they'll share their info with you. I'd be glad to, but Ga law and NJ law must be different.

Or, try googling it, you can find out just about anything on the internet these days.

There may be another issue that could pop up when you auction a shippers belongings. If the shipment contains personal information such as tax forms, credit card receipts and numbers, checks and checking account numbers and the person who purchases the shipment uses that information to steal the owners identity, who would be liable.

I wonder how we in the industry can answer this issue. I think it is a new wrinkle that will make me bid the highest (as banks do on forclosures) so I can destroy any personal information of the shipper before I resell it. If I open all the boxes to look for personal information then it makes it harder to sell.
